SUBSIDIARY PROTECTION


Since 14 November 2013, the Office of the Refugee Applications Commissioner (ORAC) has responsibility for processing subsidiary protection applications under the European Union (Subsidiary Protection) Regulations 2013 SI 426 of 2013 (pdf 1.1MB). These Regulations were subsequently amended by the European Union (Subsidiary Protection) (Amendment) Regulations 2015 (S.I. No. 137 of 2015) with effect from 20 April 2015.

Under the law
  • Any person who makes a new application for refugee status may also make an application for subsidiary protection in the Office of the Refugee Applications Commissioner (ORAC).
  • Any person who currently has an application for refugee status pending may also make an application for subsidiary protection in ORAC.

If you have already applied for subsidiary protection in the State and your application has not yet been determined, your application will automatically be transferred to the Office of the Refugee Applications Commissioner for investigation.

Please note that you do not need to make a new application for subsidiary protection and that you have permission to remain in the State until your application for subsidiary protection is determined by the Minister for Justice and Equality.

Update April 2015
In light of the Court of Justice of the European Union ruling in the case of H. N. v. The Minister for Justice, Equality and Law Reform, Ireland and the Attorney General, the European Union (Subsidiary Protection) Regulations 2013 (S.I. No. 426 of 2013) have been amended by the European Union (Subsidiary Protection) (Amendment) Regulations 2015 (S.I. No. 137 of 2015). The 2015 Regulations give statutory effect to the following arrangements which are already in place in ORAC:

  • Any person who makes a new application for refugee status may also make an application for subsidiary protection in the Office of the Refugee Applications Commissioner (ORAC).
  • Any person who currently has an application for refugee status pending may also make an application for subsidiary protection in ORAC.


Such applications for subsidiary protection will be determined by ORAC in accordance with the provisions of the European Union (Subsidiary Protection) Regulations, 2013 (S.I. No. 426 of 2013) (as amended) and will be investigated should a person’s application for refugee status be refused by the Minister for Justice and Equality.
